Defence

The defence attorney/lawyer within a criminal investigation is responsible for providing evidence which indicates the defendant is not guilty of committing the crime. The defence lawyers will present evidence which typically contradicts the prosecutors to establish that the defendant is innocent of the crime.

The roles and responsibilities of the defence will remain the same as their priority it to prove that the defendant is not guilty of committing the crime they are being accused of. However the cases that they defend will vary therefore the evidence they are presenting in court will differ depending upon the individual and the case.

Referring back to the Paul Morin case there were several defence attorneys involved all aiming to prove the innocence of himself. Within the first trial, Clayton Ruby and Mary Bartley were hired to fight the case. They were able to successfully carry out their roles and responsibility as after 13 hours of deliberation Paul Morin was not found guilty, simply because there was not a sufficient amount of evidence ti indicate that he committed the crime.  However a retrial was ordered soon after he released as they believed the jury was wrongly influenced by the judge on their decision. Jack Pinkofsky was Paul Morin's new defence lawyer, who didn't successfully prove the innocence of Paul Morin. As a result of this Morin was sentenced to prison for 25 years, without the chance of parole. However, advances in forensic technology proved the innocence of Paul Morin.
